In layman’s terms a repudiated claim refers to a decision by insurers to :-
- decline a claim on various grounds, including (but not limited to) that the policy has lapsed, or the that the contractual requirements for the insurer’s liability to pay the claim, have not been met.
- declare the contract void (invalid) on various grounds, including (but not limited to) non-disclosure of facts material to the underwriter’s assessment of the risk at application stage, or alleged fraud.
Insurers can also make a mistake in the assessment and subsequent repudiation of a claim. In fact right can also be wrong. Whilst the decision by insurer’s to repudiate a claim in accordance with the provisions of the contract is often technically correct. That does not necessarily mean that their decision is fair and final, considering the circumstances of a particular case.
How it works
Minimum Claim Value
We will consider taking on your repudiated claim or combined repudiated claims with a minimum total value of no less than R200,000-00 (Two Hundred Thousand Rand).
What will it cost me?
To assess the merits of your repudiated claim, we charge a very small fee.
What happens then?
Once we have completed our assessment, and come to the conclusion that we have a reasonable chance of successfully appealing your repudiated claim, we will :-
- advise you of our conclusion;
- provide you or the Executor of the deceased estate with the opportunity to enter into a legal and binding agreement with us.
This to enable us to pursue the appeal on their behalf on a contingency fee basis.
What is "on a contingency fee basis"?
- A contingency fee basis is where you or the executor of the deceased estate agree to pay us a percentage of the amount(s) the insurer will pay if we successfully appeal your case.
- You don’t have to pay us or our team of experts any fees to take on, and fight, your appeal for you.
- We we will do this all on risk in exchange for an agreed percentage of the payment the insurer will pay to you, if we succeed.
Disclaimer
Our contingency fee agreement more than often covers everything, including our engagements with the insurer and, if necessary, with one or more of the relevant Ombudsman schemes.
In some cases it may not cover the cost of litigation should that become necessary. As such litigation would have to be negotiated with legal practitioners, some of who may be willing to take on your case on a contingency fee basis.
Should this be the case, you or the Executor of a deceased estate will then still have the discretion to proceed on this basis or not.
A win-win-win for everyone!

Some useful information
Your insurer must comply with their contractual commitments contained in your policy schedule. There are regulations contained in the policy that dictate how the insurer must conduct themselves. These are commonly known as the Treating Customers Fairly Principles.
